OPT STEM EXTENSION HAS BEEN VACATED: What Does this Mean?

The Federal judge vacated the 2008 rule allowing the 17-month extension, A stay was put in place until February 12, 2016. DHS will have until then in order to take action regarding the fate of the STEM extension program.

But to break it down do you need to worry?

Possible situations of Students:

Currently on 12 month OPT, Need to apply for STEM EXTENSION Soon (before Feb 12 2016): Dont worry the Stay order helps you and everything will work as usual with your School and USCIS

Currently on STEM EXTENSION: Similar thing applies dont worry until Feb 12 2016

Just arrived in USA for Masters program: Don’t worry, you are still IN for the long run to know the final impact and Still the 12 months will not be affected by any means.

May Impact: Students applying STEM OPT after Feb 12th 2016, if the DHS decides to not make any  rule or cancel STEM Extension you will be affected if you dont get H1B by then you may be out of status and may also need to leave the United States. (Emphasis on the word MAY)
